Appointment must be declined, or the arbitrator must withdraw from the case.
Situations requiring mandatory disclosure; the final decision on appointment remains with the parties.
Circumstances that do not affect independence; no disclosure is required.
Take the quick test to make a preliminary assessment of any conflict of interest, and attach its results to your request for the appointment of an arbitrator.
Arbitration Practice
Commercial, sports and investment arbitration: experience «on both sides of the table», as arbitrator and as party representative.
International commercial arbitration is one of the popular means of resolving foreign trade disputes. Assistance with proceedings before an international arbitral tribunal can be provided at every stage of the arbitral resolution of a dispute:
Matters relating to the enforcement of awards of national arbitral tribunals also fall within the scope of the practice.
The specific nature of international commercial arbitration is determined by two aspects — non-procedural and procedural. The non-procedural aspect concerns the presence of a foreign element — the claimant or the respondent — and, accordingly, the need to determine the applicable substantive law. A particular feature of arbitration in Belarus is that a Belarusian arbitral tribunal must take into account, in addition to foreign legal rules, the case law of the State whose law applies.
The procedural aspect of the work of an international arbitral tribunal sets it apart significantly from a State court. Despite the flexibility of arbitral proceedings, the resolution of a dispute by an international arbitral tribunal is complicated by issues such as the constitution of the tribunal and proper notice to a party of the hearing.
Aliaksandr Danilevich’s practice «on both sides of the arbitrators’ table» — as arbitrator and as party representative — together with his long-standing academic work in this field, makes it possible to represent the client’s interests effectively in international arbitration at any stage.
Sports disputes require a thorough understanding not only of general law but also of the specific international and national sports legislation (Lex Sportiva). Depending on the nature of the conflict, such cases may be heard either by the disciplinary bodies of sports federations or by specialised arbitration courts.
Aliaksandr Danilevich is a recognised expert in sports law with extensive international and national experience. He is a member of the Court of Arbitration for Sport (TAS-CAS) in Lausanne (Switzerland), the highest appellate body in world sport, and was previously a member of the Sports Court of Arbitration at the Belarusian Republican Union of Lawyers.
Appointed by the parties or by the court for the independent, objective and final resolution of disputes at CAS or in other arbitrations.
Conducts the proceedings before a panel of arbitrators.
Protects the rights of athletes, coaches, clubs or federations at any stage of sports disputes.
An investment agreement, an international treaty and/or applicable legislation may provide for the pre-action settlement of investment disputes. Proper compliance with the pre-action procedure may resolve the dispute altogether and solve the investor’s problem, or serve as a guarantee that all requirements for bringing a claim against the State before the competent forum (ICSID, an arbitral tribunal, etc.) have been met.
The resolution of investment disputes also involves deciding the important question of the competent or most appropriate forum to hear the dispute, or assessing the arbitration clause contained in the investor–State contract.
Aliaksandr Danilevich may serve as arbitrator at the International Centre for Settlement of Investment Disputes (ICSID) and in an international commercial arbitral tribunal hearing an investment dispute. The Republic of Belarus has designated Aliaksandr Danilevich to the ICSID Panel of Arbitrators.
The settlement of investment disputes at ICSID is governed by the 1965 Washington Convention on the Settlement of Investment Disputes between States and Nationals of Other States and the Centre’s Arbitration Rules. Preparation of the claimant’s case and representation of the claimant in proceedings before the Centre are available.
The procedure for hearing investment disputes in commercial arbitral tribunals does not differ from the procedure for «ordinary» foreign trade disputes. Nevertheless, the specific nature of investment relations requires the arbitrator to take a rigorous approach to determining the investment character of the dispute itself, in order to apply international agreements on the promotion and reciprocal protection of investments.
